Trademark registration under the Trade Marks Act, 1999 grants the owner exclusive rights to use the mark for the goods or services it's registered against, and the ability to take legal action against infringement. The process begins with a prior-art search across the Trade Marks Registry database to check whether an identical or deceptively similar mark already exists in the relevant class — filing without this step risks a straightforward objection or, worse, opposition from an existing owner later.

Correct class selection under the NICE Classification (45 classes covering goods and services) and a precise specification of goods/services matter as much as the mark itself — an overly broad specification invites objection, while too narrow a specification leaves gaps in protection. We advise on class strategy based on the applicant's actual and reasonably foreseeable business activities.

Once filed, the application is examined by the Registrar, and if no objection is raised (or objections are cleared), the mark is published in the Trade Marks Journal for opposition. If unopposed within the statutory window, the certificate of registration is issued.

It's not mandatory, but strongly advisable — filing without a prior search risks the Registrar raising a conflict-based objection, or a third party opposing the mark later, either of which costs more time and money than a search would have.
Yes, a single application can cover multiple classes, though the fee is charged per class. We advise on whether multi-class filing makes sense based on your current and reasonably near-term business activities.
A word mark protects the specific words/text regardless of font or styling; a device/logo mark protects the visual representation as filed. Many applicants register both, or a combined mark, depending on which elements of their brand identity need protection.
The ™ symbol can be used once an application is filed, signalling a claimed trademark; the ® symbol should only be used after the mark is actually registered, since using it prematurely can itself create legal issues.
