Every registered public charitable trust has a dual annual accounts obligation: submission of audited accounts to the Charity Commissioner under the applicable state trust legislation, and filing of the statutory audit report in Form 10B with the Income Tax Department as part of the ITR-7 return. Both submissions are mandatory for trusts with 12AB registration to maintain their income tax exemption, and failure to comply can result in the exemption being denied for the year.

The accounts must be prepared in the specific formats required by each authority. The Charity Commissioner requires an income and expenditure account, a receipts and payments account, and a balance sheet — typically in the format prescribed by the state trust legislation. Form 10B, filed with the income tax return, requires the auditor to certify the trust's compliance with the conditions of Section 11 exemption, including the 85% application of income requirement, corpus fund investments, and related-party transactions.

Frequently Asked Questions

A registered public charitable trust must submit audited annual accounts — including an income and expenditure account, a receipts and payments account, and a balance sheet — to the Charity Commissioner. It must also file Form 10B (audit report) with its ITR-7 income tax return.
Form 10B is the audit report that a Chartered Accountant must issue for a charitable trust registered under Section 12AB. It certifies, among other things, that the trust has applied at least 85% of its income for charitable purposes, investments are in prescribed modes, and related-party transactions are disclosed.
Under Section 11 of the Income Tax Act, a registered trust must apply at least 85% of its income for charitable or religious purposes in India during the year. The remaining 15% can be accumulated. If the 85% target is not met, the shortfall is taxable.
Under most state trust legislation, the annual accounts must be submitted to the Charity Commissioner within 6 months of the close of the financial year — by September 30 for a March 31 year-end. Specific deadlines vary by state.
For trusts required to file Form 10B (i.e., trusts subject to audit), the ITR-7 return must be filed by October 31 each year (or by November 30 if the trust has international transactions requiring a transfer pricing report). These deadlines are subject to change by CBDT notification.
Non-filing of ITR-7 results in loss of the Section 11 income tax exemption for the year — meaning the trust's entire income becomes taxable. Late filing after the deadline also attracts penalties under Section 234F of the Income Tax Act.
