While the structure is simple, the compliance obligations are real: the proprietor must file an annual income tax return reporting business income under Sections 44AD (presumptive basis) or under the regular books-of-accounts method, pay advance tax quarterly, comply with GST obligations if turnover exceeds the threshold, and maintain the required books of accounts if the tax audit threshold is crossed.
The income tax treatment of a proprietorship depends on the nature and scale of the business. Businesses with turnover up to INR 3 crore (for cash transactions) or INR 2 crore (for digital transactions) can opt for the presumptive taxation scheme under Section 44AD, declaring 8% or 6% of turnover as income without maintaining detailed accounts. Professionals can use Section 44ADA (up to INR 75 lakh). Beyond these thresholds, regular accounts must be maintained and tax audit under Section 44AB is mandatory.
