The process begins with a prior-art search across the Trade Marks Registry database to check whether an identical or deceptively similar mark already exists in the relevant class — filing without this step risks a straightforward objection or, worse, opposition from an existing owner later.
Correct class selection under the NICE Classification (45 classes covering goods and services) and a precise specification of goods/services matter as much as the mark itself — an overly broad specification invites objection, while too narrow a specification leaves gaps in protection. We advise on class strategy based on the applicant's actual and reasonably foreseeable business activities.
Once filed, the application is examined by the Registrar, and if no objection is raised (or objections are cleared), the mark is published in the Trade Marks Journal for opposition. If unopposed within the statutory window, the certificate of registration is issued.
