Contact UsGST registration cancellation is a formal process under Section 29 of the CGST Act by which a registered taxpayer permanently closes their GST registration. Cancellation may be applied for voluntarily — where the business has ceased operations, fallen below the mandatory registration threshold, or is restructuring through merger, demerger, or change in constitution. Cancellation can also be initiated by the GST officer — where the taxpayer has failed to file returns, conducted business from an undeclared address, issued invoices without supply, or violated other GST provisions.
The voluntary cancellation process begins with filing Form GST REG-16 on the GST portal — specifying the reason for cancellation, the date from which cancellation is sought, the details of the business (if transferred by amalgamation or otherwise), and the address of the stock held on the cancellation date. On receipt of the application, the officer may issue a show cause notice in Form GST REG-17 before proceeding to cancellation — the taxpayer must respond to preserve the intended cancellation date. Once the cancellation order is issued in Form GST REG-19, the taxpayer must file the final return in Form GSTR-10 within 3 months.
GSTR-10 is the final return — it captures the closing stock on the date of cancellation and requires reversal of ITC on that stock. The ITC reversal equals the higher of: the ITC proportionate to the closing stock; or the output tax payable on the stock at the applicable rate. This ITC reversal is the most material financial obligation arising from cancellation — and must be computed correctly. Failure to file GSTR-10 within 3 months results in automatic best judgement assessment of the ITC reversal with interest and penalty.
