Contact UsWhen TDS is deducted at the standard rates but the taxpayer’s actual tax liability for the year is lower — due to deductions, exemptions, losses, or treaty benefits — significant working capital is locked up in TDS refunds that take months to process. Section 197 of the Income Tax Act, 1961 provides the remedy: the taxpayer can apply to the Assessing Officer for a certificate authorising TDS to be deducted at a lower rate or not at all.
The application is filed online through the TRACES portal in the prescribed form. For residents, it is filed in Form 13; for non-residents claiming DTAA benefits, the process involves a different route via the Assessing Officer. The AO reviews the application, and if satisfied that the estimated tax liability justifies a lower rate, issues the certificate specifying the lower rate and the validity period.
The certificate, once obtained, is provided to all deductors who make payments to the taxpayer. They are then obligated to deduct TDS at the certificate rate rather than the standard rate.
